- “Company” means New Town Development Company Limited, the owner and manager that exploits and develops project.
- “Club” means the Club of Legend Danang Golf Resort, consisting of 02 (two) 18 holes golf courses designed by Greg Norman and Jack Nicklaus, a clubhouse, a driving range and other subsidiary facilities.
- “Charter” means this “The Charter of Legend Danang Golf Resort” and all subsequent charters amended and supplemented from time to time.
- “Honorary Members” are persons who satisfy criteria and conditions according to the Company’s regulations for Honorary membership and are offered priority by the Company to join the Club with Honorary membership cards.
- “Complimentary, Elite or Prestige Members” are persons who satisfy criteria and conditions according to the Company’s regulations for Complimentary membership and are offered to join the Club with Complimentary/Elite/Prestige membership cards.
- “Individual Members” are persons who have registered voluntarily for the Club’s Individual membership, have received the approval from the Company Leader and have been issued a membership card according to the regulations of the Company.
- “Corporate Members” are corporations that have registered voluntarily for the Club’s Corporate membership, have received the approval from the Company Leader and have been issued a membership card according to the regulations of the Company.
- “Nominee Members” are members/staffs of the corporation that owns Corporate membership card, who is authorized by the corporation in writing to use the Corporate membership card in the designated period.
- “Floating Members” are equal to Corporate Members with the exception that the nominee’s name is not displayed on the membership card, but only the name of Corporate card owner.
- “Short-term Members” are persons who have registered voluntarily for a Club’s Short-term membership for a period from 01 (one) to 05 (five) years or otherwise stated by the Company, have received the approval from the Company Leader and have been issued a Short-term membership card.
- “Long-term Members” are persons who have registered voluntarily for a Club’s Long-term membership for a period of from 06 (six) years to 17/12/2056 or otherwise stated by the Company, have received the approval from the Company Leader and have been issued a Long-term membership card.
- “Junior Members” are persons between the age of 08 (eight) to under 16 (sixteen) years old, who have registered voluntarily for the Club’s Junior membership with the confirmation of their legal guardian, have received the approval from the Company Leader and have been issued a membership card according to the regulations of the Company.
- “Associate Members” are the spouse or children between the age of 08 (eight) to under 18 (eighteen) years old of an Individual Member or a nominee of Corporate Member, have registered voluntarily for the Club’s Associate membership, have received the approval from the Company Leader and have been issued a membership card.
- “Player” is Member, Member’s Guest or other golfer who comes to play golf at the Club.
- “Member’s Guest” is any person who does not have a membership card brought to the Club by a Member for the purpose of playing golf, and must meet all the requirements according to the Club’s regulations.
- “Visitor” is anyone who does not have a membership card but is allowed by the Manager to enter the Club to play golf, visit or to participate in conferences or events.
- “Joining Fee” and “Related Conditions” means fees for joining the Club and proper conditions for being Members of the Club.
- “Annual dues” is an annual fee collected by the Company for maintaining the facilities, golf course improvements, and other issues according to the Company’s decision.

- “Active fee” is the annual due which allows Member to play more than 12 (twelve) times per year after payment in full of the set dues.

- “Out of Town fee” is the annual due which allows Member to play 12 (twelve) times or less per year after payment in full of the set dues.

- “Absent fee” is the annual due for a member who chooses not play any rounds during the 12 (twelve) months of relevant annual due period.“Membership Card” means the card issued to the Club’s Member to certify that its holder possesses the privileges and obligations of a Member of the Club according to the regulations of the Company.
- “Membership Card” means the card issued to the Club’s Member to certify that its holder possesses the privileges and obligations of a Member of the Club according to the regulations of the Company.
- “Transferor” is a Member of the Club who wishes to transfer the membership to other person or corporation under the type and terms of the membership privileges, has received the approval from the Company Leader and has to pay the related fees in according with the policy and regulations of the Company.
- “Transferee” is a person or corporation who wishes to join the Club by taking on the membership from Transferor, has received the approval from the Company Leader and has to pay the related fees with the policy and regulations of the Company.
- “Member’s Privileges” means the member’s privileges and other benefits associated with using the golf course, clubhouse and other facilities of the Club as regulated within the Charter.
- “Manager” means the person(s) and/or corporation(s) appointed or employed by the Company to manage and carry out the daily operations of the Club and is/are under the direct control and management of the Company Leader.
- “Company Leader” means Chairman of the Member Board/ Directors of the Company and/or authorized manager to control and run the daily operations of the Company.
- “The Course” includes 02 (two) 18 holes golf courses designed by Greg Norman and Jack Nicklaus, where golf is played.
- “Tee time” is the reserved start time for a round of golf under the Regulations of the Club.
- “Group” is a number of players with minimum 02 (two) and maximum 04 (four) who have booked the tee time on the reservation system.
- “Night Golf” is a game of golf that includes play aided by artificial lights from flood lights aligning the golf course holes during playing time according to the Regulations of the Club.
- “Handicap" is a measurement of a golfer's potential playing ability based on the scores of their best 10 rounds out of their most recent 20 rounds played on the course.
- “Driving Range” is the area used for golf practice including the buildings, tee deck, putting green and bunker(s) and target greens of the Club.
